SportstarZ Gymnastics | Flexible Cancellation Policy
Article 1 – General
1.1 SportstarZ Gymnastics offers the Booker the option, during the registration process, to make use of the Flexible Cancellation Policy.
1.2 The Flexible Cancellation Policy is an additional commercial service provided by SportstarZ Gymnastics. It is intended to provide additional financial security in a limited number of unexpected situations in which a Participant is unable to attend the Gymnastics Camp.
1.3 The Flexible Cancellation Policy is not insurance, cancellation insurance or an insurance product. There is no insurer, insurance policy or external insurance company involved.
1.4 The Flexible Cancellation Policy only applies when it has been selected during the registration process, the applicable fee has been paid and all conditions of this policy have been met.
Article 2 – Fee and registration
2.1 The Flexible Cancellation Policy costs €49.99 per booking.
2.2 The fee for the Flexible Cancellation Policy is separate from the Booking Amount and the Booking Fee.
2.3 The Flexible Cancellation Policy can only be selected during the registration process. It cannot be added after the registration has been completed.
2.4 The fee for the Flexible Cancellation Policy is non-refundable.
Article 3 – Situations covered by the policy
3.1 When all conditions of this policy have been met, the Booker may be entitled to a refund in the following situations:
a. illness of the Participant that makes participation in the Gymnastics Camp impossible;
b. an accident involving the Participant that makes participation in the Gymnastics Camp impossible;
c. death of a family member of the Participant in the first or second degree;
d. serious illness or a life-threatening situation involving a family member of the Participant in the first or second degree;
e. an accident involving or hospitalisation of a family member of the Participant in the first or second degree.
3.2 Only the situations specifically listed in Article 3.1 are covered by the Flexible Cancellation Policy.
3.3 Other reasons for cancellation are not covered by this policy, including changed personal circumstances, school obligations, holiday plans, transport problems, homesickness, the Participant no longer wishing to attend the Gymnastics Camp or other personal reasons.
Article 4 – Supporting documents
4.1 A cancellation based on illness or an accident involving the Participant must be supported by a medical certificate.
4.2 The medical certificate must relate to the relevant situation and sufficiently demonstrate that the Participant is unable to participate in the Gymnastics Camp as a result of the illness or accident.
4.3 A statement from the Participant, Booker, parent or legal representative is not sufficient as medical evidence.
4.4 SportstarZ Gymnastics may request additional supporting documents where reasonably necessary to assess whether the conditions of the Flexible Cancellation Policy have been met.
4.5 If the required supporting documents are not provided, SportstarZ Gymnastics may reject the cancellation under the Flexible Cancellation Policy.
Article 5 – Reporting deadline
5.1 A claim under the Flexible Cancellation Policy must be reported to SportstarZ Gymnastics in writing as soon as reasonably possible and no later than 5 calendar days after the situation giving rise to the cancellation has occurred.
5.2 The cancellation must in all cases be received by SportstarZ Gymnastics no later than 24 hours before the official start of the relevant Gymnastics Camp.
5.3 The moment at which SportstarZ Gymnastics actually receives the written cancellation is decisive.
Article 6 – Expiry of the right to use the policy
6.1 From 24 hours before the official start of the Gymnastics Camp, the right to make use of the Flexible Cancellation Policy expires.
6.2 This applies regardless of when the situation giving rise to the cancellation occurred.
6.3 If the situation occurs within 24 hours before the official start of the Gymnastics Camp, the Flexible Cancellation Policy can no longer be used.
6.4 If the cancellation is not received by SportstarZ Gymnastics no later than 24 hours before the official start of the Gymnastics Camp, no refund can be claimed under the Flexible Cancellation Policy.
6.5 A situation that occurred before the expiry of the reporting period but was only reported after the deadline does not give rise to a right to a refund under the Flexible Cancellation Policy.
6.6 The Flexible Cancellation Policy also does not apply to situations arising during the Gymnastics Camp.
6.7 This includes illness, an accident, early departure, non-attendance at the start of the Gymnastics Camp, partial participation or inability to complete the programme after the 24-hour deadline has expired.
Article 7 – Refund
7.1 When all conditions of the Flexible Cancellation Policy have been met, SportstarZ Gymnastics will refund the amount of the Booking Amount that has actually been paid by the Booker.
7.2 The Booking Fee of €25 and the fee of €49.99 for the Flexible Cancellation Policy are not refundable.
7.3 If the Booker has only paid the deposit at the time of cancellation, only the amount of the deposit that has actually been paid, less the Booking Fee and the Flexible Cancellation Fee, can be refunded.
7.4 The Flexible Cancellation Policy does not provide a refund of amounts that have not yet been paid.
7.5 The refund under this policy relates only to amounts actually paid for the relevant booking and to the extent that the conditions of this policy have been met.
Article 8 – Procedure
8.1 A cancellation under the Flexible Cancellation Policy must be submitted in writing by the Booker.
8.2 The cancellation must clearly state the reason for cancellation and, where applicable, be accompanied by the required supporting documents.
8.3 SportstarZ Gymnastics will assess the submitted information and determine whether the conditions of the Flexible Cancellation Policy have been met.
8.4 Only situations that fall within the categories listed in Article 3 and that meet all other conditions of this policy qualify for a refund.
8.5 The Flexible Cancellation Policy is a commercial service provided by SportstarZ Gymnastics itself. SportstarZ Gymnastics is responsible for its implementation and assessment.
Article 9 – Standard cancellation conditions
9.1 The Flexible Cancellation Policy is an additional service and does not replace the standard cancellation conditions of SportstarZ Gymnastics.
9.2 If the conditions of the Flexible Cancellation Policy have not been met, the standard cancellation conditions as set out in the General Terms and Conditions remain applicable.
9.3 Payment of the Flexible Cancellation Fee does not automatically entitle the Booker to a refund. All conditions of this policy must be met.
Article 10 – Statutory rights
10.1 The Flexible Cancellation Policy is an additional service provided by SportstarZ Gymnastics. This policy does not affect any statutory rights of the Booker or Participant.
Article 11 – Acceptance
11.1 By selecting the Flexible Cancellation Policy during the registration process and paying the applicable fee, the Booker confirms that they have read, understood and accepted the conditions of this Flexible Cancellation Policy.
11.2 The Flexible Cancellation Policy applies only to the booking for which the policy was selected and paid.
