GENERAL TERMS AND CONDITIONS SPORTSTARZ GYMNASTICS

1. Definitions
1.1 The following definitions apply in these General Terms and Conditions:
1.2 “Participant”: the natural person participating in a Gymnastics Camp organised by SportstarZ Gymnastics.
1.3 “Booker”: the natural person who registers the Participant, enters into the agreement with SportstarZ Gymnastics and is responsible for payment of the booking. Where the Participant is a minor, the Booker will generally be the parent or legal representative of the Participant.
1.4 “Registration Form”: the online form used by the Booker to register a Participant for a Gymnastics Camp or other activity offered by SportstarZ Gymnastics.
1.5 “Agreement”: the agreement between SportstarZ Gymnastics and the Booker concerning participation in a Gymnastics Camp or other activity offered by SportstarZ Gymnastics.
1.6 “Booking Amount”: the total amount owed by the Booker to SportstarZ Gymnastics for participation in the relevant Gymnastics Camp, excluding separately stated Booking Fees and excluding the Flexible Cancellation Fee. The Booking Amount includes all components and services included in the relevant booking, such as training, accommodation, meals, activities and any included transportation.
1.7 “Booking Fee”: the separately charged amount of €25 per booking for the administrative processing of the registration. The Booking Fee does not form part of the Booking Amount and is non-refundable in the event of cancellation, to the extent permitted by law.
1.8 “Flexible Cancellation Arrangement”: the additional commercial service offered by SportstarZ Gymnastics under which the Booker, upon payment of a separate fee and subject to the conditions of the separate Flexible Cancellation Arrangement, may be entitled to a refund in certain situations specified therein.
1.9 “Flexible Cancellation Fee”: the separately payable amount of €49.99 per booking for participation in the Flexible Cancellation Arrangement. This fee does not form part of the Booking Amount and is non-refundable.
1.10 “SportstarZ Gymnastics”: the business operating under the trade name SportstarZ Gymnastics.
1.11 “Gymnastics Camp”: the gymnastics camp organised by SportstarZ Gymnastics during which Participants take part in training and, where applicable, recreational activities and stay at a location designated by SportstarZ Gymnastics for a predetermined period.
1.12 “Bike Rental Provider”: the natural person or legal entity that rents or provides bicycles or other cycling equipment to SportstarZ Gymnastics or the Participant.
2. Applicability
2.1 These General Terms and Conditions apply to all offers, registrations, reservations, confirmations and Agreements of SportstarZ Gymnastics, unless otherwise agreed in writing.
2.2 By submitting a registration, the Booker declares that they have read and accepted these General Terms and Conditions.
2.3 These General Terms and Conditions are made available to the Booker before or at the time the Agreement is concluded.
2.4 Deviations from or additions to these General Terms and Conditions are only valid if confirmed in writing by SportstarZ Gymnastics.
2.5 If a provision in an individual Agreement differs from these General Terms and Conditions, the individually agreed provision confirmed in writing shall prevail.
2.6 If any provision of these General Terms and Conditions is null and void, annulled or otherwise found to be legally invalid, the remaining provisions shall remain in full force to the fullest extent possible.
2.7 If mandatory law applies and differs from a provision of these General Terms and Conditions, the mandatory law shall prevail.
3. Formation of the Agreement
3.1 All offers made by SportstarZ Gymnastics are non-binding and subject to available capacity, unless otherwise stated.
3.2 The Agreement is concluded when the Booker has fully completed and submitted the Registration Form and SportstarZ Gymnastics has confirmed the registration, or when the Booker has given written acceptance of a written quotation or other offer from SportstarZ Gymnastics.
3.3 The registration becomes final once SportstarZ Gymnastics has confirmed the reservation and, where applicable, the required deposit has been received on time.
3.4 Registrations are processed based on available capacity and, where applicable, in the order in which payments are received.
3.5 When the maximum number of Participants for a Gymnastics Camp has been reached, SportstarZ Gymnastics may refuse a registration or place the Participant on a waiting list.
3.6 When specific age, level or other admission requirements apply to a Gymnastics Camp, SportstarZ Gymnastics may refuse a registration if the Participant does not meet these requirements.
4. Payment
4.1 The Booking Amount must be paid in accordance with the payment terms applicable to the relevant booking.
4.2 For a regular registration, the deposit is 45% of the Booking Amount, unless a different percentage or amount is stated in the booking.
4.3 The deposit must be paid within the period stated on the reservation confirmation or invoice.
4.4 The remaining amount of the Booking Amount must be paid no later than 45 days before the first day of the Gymnastics Camp, unless otherwise agreed in writing.
4.5 For a reservation made within 45 days before the first day of the Gymnastics Camp, the full Booking Amount must be paid within the period specified by SportstarZ Gymnastics and no later than before the start of the Gymnastics Camp.
4.6 The Booking Fee and, where applicable, the Flexible Cancellation Fee are stated separately and do not form part of the Booking Amount.
4.7 If a payment is not received on time or in full, the Booker shall be in default without further notice, to the extent permitted by law.
4.8 In the event of late payment, SportstarZ Gymnastics reserves the right to cancel the registration or Agreement, subject to the applicable statutory rules.
5. Instructions and Rules of Conduct
5.1 The Participant must follow all reasonable instructions given by SportstarZ Gymnastics, trainers, supervisors and staff.
5.2 During the Gymnastics Camp, the Participant must comply with the rules of conduct of SportstarZ Gymnastics and with the rules of the accommodation, training location and other locations visited during the Gymnastics Camp.
5.3 The Participant must behave in such a way that the safety, wellbeing and enjoyment of other Participants, staff and third parties are not endangered.
5.4 If a Participant causes serious nuisance or disruption or behaves in such a way that the proper and safe organisation of the Gymnastics Camp is significantly compromised, SportstarZ Gymnastics may take appropriate measures.
5.5 In serious cases, SportstarZ Gymnastics may exclude the Participant from further participation in the Gymnastics Camp.
5.6 If a Participant is excluded from further participation due to serious misconduct or failure to comply with the rules of conduct, there shall in principle be no entitlement to a refund.
5.7 Any reasonable and demonstrable costs directly resulting from such exclusion may, to the extent permitted by law, be charged to the Booker.
5.8 The Participant may not leave the Gymnastics Camp or the accommodation without permission when supervision is required.
6. Health and Medical Information
6.1 The Participant must be physically and mentally capable of participating safely in the Gymnastics Camp and the activities associated with it.
6.2 The Booker and/or Participant is responsible for providing relevant information in advance concerning medical circumstances, injuries, allergies, medication, dietary requirements and other circumstances that may be relevant to safe participation.
6.3 The Participant and Booker remain responsible for the proper use of prescribed medication and for following medical advice.
6.4 SportstarZ Gymnastics will take relevant medical information provided in advance into account within reasonable limits, but cannot guarantee that every individual medical or personal need can be fully accommodated.
6.5 The Participant must have valid health insurance throughout participation in the Gymnastics Camp.
6.6 Any medical costs incurred during the Gymnastics Camp, including costs for a general practitioner, hospital, physiotherapy, medication or other medical treatment, are the responsibility of the Participant and/or Booker, to the extent that these costs are not reimbursed by insurance or another third party.
6.7 SportstarZ Gymnastics is not liable for medical costs that are not or are not fully reimbursed by the Participant’s health insurance or other insurance, to the extent that such limitation is legally permitted.
7. Liability of SportstarZ Gymnastics
7.1 Participation in gymnastics and other sporting activities involves risks. The Participant participates while accepting the normal risks associated with sports activities.
7.2 SportstarZ Gymnastics is liable for damage to the extent that such damage results from an attributable failure by SportstarZ Gymnastics or from intent or wilful recklessness by SportstarZ Gymnastics, insofar as such liability cannot legally be excluded or limited.
7.3 SportstarZ Gymnastics is not liable for loss, theft or damage to the Participant’s personal belongings, unless this concerns circumstances for which SportstarZ Gymnastics is legally liable.
7.4 Luggage, clothing, phones, jewellery and other personal belongings remain at the risk of the Participant and/or Booker.
7.5 Where a claim can be made under an insurance policy of the Participant, Booker or a third party for certain damage, the relevant damage must first be reported to that insurer.
7.6 To the extent permitted by law, the liability of SportstarZ Gymnastics is limited to the amount actually paid for the relevant participation in the Gymnastics Camp.
7.7 The limitations of liability in this article do not apply where limitation of liability is not permitted under mandatory law.
7.8 SportstarZ Gymnastics is not liable for damage that is exclusively the result of an act or omission by an independent third party, unless SportstarZ Gymnastics is legally liable for such damage.
8. Liability of the Booker
8.1 The Booker is responsible for providing correct and complete information about the Participant.
8.2 To the extent permitted by law, the Booker is responsible for ensuring compliance with these General Terms and Conditions by the Participant.
8.3 The Booker is liable for damage suffered by SportstarZ Gymnastics or a third party as a direct result of an attributable failure or unlawful act by the Participant, to the extent that such damage can legally be attributed to the Booker.
8.4 The Booker is responsible for providing correct personal data, including name and date of birth and, where relevant, identification details.
8.5 Any consequences of incorrect or incomplete information provided by the Booker shall be borne by the Booker to the extent that these consequences can reasonably be attributed to the Booker.
9. Changes and Force Majeure
9.1 SportstarZ Gymnastics may change the programme, training location, accommodation, activities or other components of the Gymnastics Camp when this is reasonably necessary.
9.2 If a change is necessary due to circumstances beyond the reasonable control of SportstarZ Gymnastics, SportstarZ Gymnastics will make reasonable efforts to provide an appropriate solution.
9.3 Such circumstances may include, among other things, severe weather conditions, natural disasters, epidemics or pandemics, war, terrorism, government measures, strikes, serious safety risks, the unavailability of accommodation or training locations and other circumstances that could reasonably not have been prevented.
9.4 Insufficient registrations may also constitute grounds for cancelling a Gymnastics Camp where this was stated in advance for the relevant Gymnastics Camp.
9.5 If SportstarZ Gymnastics has to cancel a Gymnastics Camp before its start, the Booker will be informed as soon as reasonably possible.
9.6 In the event of cancellation by SportstarZ Gymnastics, the Booker will, depending on the circumstances and applicable statutory rules, receive an appropriate solution or refund of the amounts to which the Booker is entitled.
9.7 SportstarZ Gymnastics is not liable for costs independently incurred by the Booker or Participant that do not form a direct part of the Agreement, such as flights, train journeys, fuel costs or other external transportation costs, insofar as SportstarZ Gymnastics is not legally liable for such costs.
10. Cancellation by the Booker
10.1 Cancellation by the Booker must be submitted to SportstarZ Gymnastics in writing.
10.2 The moment at which SportstarZ Gymnastics actually receives the written cancellation shall be considered the time of cancellation.
10.3 In the event of cancellation by the Booker, subject to any statutory rights and subject to a valid application of the Flexible Cancellation Arrangement, the following cancellation charges apply:
a. cancellation up to 45 days before the first day of the Gymnastics Camp: the amount of the deposit of the Booking Amount;
b. cancellation from 45 days up to 20 days before the first day of the Gymnastics Camp: 75% of the Booking Amount;
c. cancellation within 20 days before the first day of the Gymnastics Camp: 100% of the Booking Amount.
10.4 The Booking Fee of €25 is non-refundable in the event of cancellation.
10.5 The Flexible Cancellation Fee of €49.99 is non-refundable in the event of cancellation.
10.6 The cancellation charges referred to in this article are calculated on the Booking Amount and not on the separately charged Booking Fee or Flexible Cancellation Fee.
10.7 If the Booker is entitled to make use of the Flexible Cancellation Arrangement, the conditions of the separate Flexible Cancellation Arrangement shall apply.
10.8 The Flexible Cancellation Arrangement is an additional service and modifies the standard cancellation conditions of this article only when all conditions of that arrangement have been met.
11. Change of Participant
11.1 The Booker may request SportstarZ Gymnastics to change the name of the Participant or to allow another person to participate in place of the originally registered Participant.
11.2 A change is only possible when this is practically feasible and the replacement Participant meets the conditions applicable to the relevant Gymnastics Camp.
11.3 SportstarZ Gymnastics may charge an administrative fee of €25 for an administrative change.
11.4 SportstarZ Gymnastics may refuse a change when it is reasonably not feasible or when the replacement person does not meet the conditions of the Gymnastics Camp.
12. Insurance
12.1 Participants must have valid health insurance throughout the Gymnastics Camp.
12.2 SportstarZ Gymnastics strongly recommends that the Booker and Participant also take out appropriate travel and accident insurance with sports coverage.
12.3 The Booker and/or Participant is responsible for checking whether their own insurance provides sufficient coverage for participation in the Gymnastics Camp, including sports activities, medical costs, accidents and personal belongings.
12.4 SportstarZ Gymnastics is not responsible for the coverage, conditions or exclusions of an insurance policy taken out by the Booker or Participant themselves.
12.5 Participants from other EU countries are advised to have a valid European Health Insurance Card (EHIC) or other valid proof of healthcare coverage.
13. Bicycle Rental
13.1 If a bicycle is rented or provided during the Gymnastics Camp, the Participant must use it carefully and in accordance with the instructions of SportstarZ Gymnastics and/or the Bike Rental Provider.
13.2 The bicycle must be parked in suitable locations and, if a lock has been provided, secured in the prescribed manner.
13.3 The Participant and/or Booker is responsible for fines and other costs resulting from violations of traffic regulations or other applicable rules by the Participant, to the extent that these costs can be attributed to the Participant and/or Booker.
13.4 The Participant may not use the bicycle in places or under circumstances for which the bicycle is not suitable.
13.5 In the event of loss, theft, an accident or damage to the bicycle, the Participant must report this as soon as possible and no later than two hours after this has been discovered to both the Bike Rental Provider and SportstarZ Gymnastics.
13.6 Where applicable, the Participant or Booker must provide a relevant statement or report, such as a police report in the event of theft, to the Bike Rental Provider and SportstarZ Gymnastics.
13.7 The bicycle and other rented equipment must be returned after use in the condition in which they were received, taking normal wear and tear into account.
13.8 In the event of loss, theft or damage, the Participant and/or Booker may be liable for the actual damage incurred, to the extent that this damage can be attributed to the Participant and/or Booker.
13.9 If transportation during the Gymnastics Camp takes place wholly or partly by bicycle, the Booker declares that the Participant has sufficient basic cycling skills to participate safely in bicycle traffic.
13.10 The Participant is responsible for complying with traffic regulations.
14. Transportation
14.1 When transportation during the Gymnastics Camp is provided by SportstarZ Gymnastics or by a transport provider engaged by SportstarZ Gymnastics, the Participant must follow the instructions of the supervisors and transport provider.
14.2 When transportation is provided by an external transport provider, that transport provider is responsible for the execution of the transportation, unless otherwise provided by law.
14.3 Delays, changes or cancellation of transportation may result in changes to the programme when this is reasonably necessary.
15. Delays and Changes to the Programme
15.1 SportstarZ Gymnastics may adjust the programme when this is necessary due to weather conditions, safety, availability of accommodation or training facilities, delays, illness of staff, technical circumstances or other circumstances that prevent the programme from being carried out normally.
15.2 SportstarZ Gymnastics will make reasonable efforts to provide an appropriate alternative if a programme component is cancelled, where this is reasonably possible.
15.3 If a programme component cannot be carried out due to circumstances reasonably beyond the control of SportstarZ Gymnastics, this does not automatically create an entitlement to a refund.
15.4 If a statutory provision in a specific situation grants a right to a refund or other compensation, that statutory provision shall remain applicable.
16. Merchandise
16.1 SportstarZ Gymnastics provides a six-month warranty, under normal use and maintenance, against material and manufacturing defects in merchandise products, unless the law provides for a longer statutory period of protection.
16.2 Wear and tear resulting from normal or intensive use, improper use, incorrect maintenance or damage caused by external circumstances is not covered by this additional warranty provision, to the extent permitted by law.
16.3 Any postage or transportation costs may be charged to the customer to the extent permitted by law.
17. Flexible Cancellation Arrangement
17.1 SportstarZ Gymnastics offers the Booker the option to make use of the Flexible Cancellation Arrangement during the registration process.
17.2 The conditions of the Flexible Cancellation Arrangement are set out in a separate policy that is made available during the registration process.
17.3 The Flexible Cancellation Fee is €49.99 per booking.
17.4 The Flexible Cancellation Fee is separate from the Booking Amount and the Booking Fee.
17.5 The Flexible Cancellation Arrangement can only be added during the registration process and cannot be added after the registration has been completed.
17.6 The Flexible Cancellation Arrangement is not insurance, cancellation insurance or an insurance product.
17.7 The arrangement applies only when the Booker has selected it during the registration process, has paid the Flexible Cancellation Fee and has complied with all conditions of the separate policy.
17.8 The Flexible Cancellation Fee is non-refundable in the event of cancellation.
17.9 If the Booker does not make use of the Flexible Cancellation Arrangement, the standard cancellation conditions of Article 10 remain applicable.
17.10 The Flexible Cancellation Arrangement does not affect any statutory rights of the Booker or Participant.
18. Lost Property
18.1 Lost property will be kept by SportstarZ Gymnastics for a maximum of three weeks after the Gymnastics Camp.
18.2 During this period, the Booker or Participant may contact SportstarZ Gymnastics to arrange the return of a lost item.
18.3 After this period has expired, SportstarZ Gymnastics is entitled to donate, destroy or otherwise dispose of the item.
19. Photo and Video Recordings
19.1 Photos and video recordings may be taken during SportstarZ activities.
19.2 SportstarZ Gymnastics may use images in which a Participant is recognisable for communication and promotional purposes where there is a valid legal basis for such use.
19.3 Where separate consent is required for a particular use, SportstarZ Gymnastics will obtain such consent in an appropriate manner.
19.4 The use of personal data and image material is subject to the privacy policy of SportstarZ Gymnastics and applicable privacy legislation.
20. Complaints
20.1 A complaint concerning the Gymnastics Camp, its execution or any part of the services provided should be reported to SportstarZ Gymnastics as soon as possible.
20.2 If a complaint arises during the Gymnastics Camp, the Participant or Booker should report it as soon as possible to the SportstarZ staff present, so that SportstarZ Gymnastics has the opportunity to resolve the issue during the Gymnastics Camp.
20.3 A complaint submitted after the Gymnastics Camp must be submitted in writing and described as specifically as possible.
20.4 SportstarZ Gymnastics will assess and respond to a received complaint within a reasonable period.
21. Applicable Law and Disputes
21.1 The Agreement and these General Terms and Conditions are governed by Dutch law, insofar as mandatory law does not provide otherwise.
21.2 Where mandatory consumer law applies, such provisions shall remain fully applicable.
21.3 The Dutch version of these General Terms and Conditions is the leading version. An English translation is provided for information purposes only. In the event of any differences between the Dutch and English versions, the Dutch version shall prevail.
21.4 Disputes shall be submitted to the court that has jurisdiction under the applicable statutory rules.
21.5 Nothing in these General Terms and Conditions limits the right of a consumer to bring a dispute before a court that has jurisdiction under mandatory law.
